These terms govern your use of the Brim Collection website. Brim Collection is a custom print and embroidery business based in Oklahoma.

1. Terms

By accessing this website, you agree to be bound by these website Terms and Conditions of Use, all applicable laws and regulations, and you agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on BRIM COLLECTION's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• modify or copy the materials;
• use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
• attempt to decompile or reverse engineer any software contained on BRIM COLLECTION's website;
• remove any copyright or other proprietary notations from the materials; or
• transfer the materials to another person or "mirror" the materials on any other server.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by BRIM COLLECTION at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession, whether in electronic or printed format.

Designs, logos, photographs, and other artwork appearing on this site remain the property of BRIM COLLECTION or of the respective clients who own them, and may not be reproduced without permission. If you submit artwork to us for a quote or an order, you represent that you own the rights to that artwork or are authorized to use it, and you remain responsible for any third-party rights attached to it.

The materials on BRIM COLLECTION's website are provided "as is". BRIM COLLECTION makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, BRIM COLLECTION does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

5. Limitations

In no event shall BRIM COLLECTION or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on BRIM COLLECTION's website, even if BRIM COLLECTION or a BRIM COLLECTION authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

BRIM COLLECTION does not warrant that any of the materials on its website are accurate, complete, or current. BRIM COLLECTION may make changes to the materials contained on its website at any time without notice. BRIM COLLECTION does not, however, make any commitment to update the materials.

BRIM COLLECTION has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by BRIM COLLECTION of the site. Use of any such linked website is at the user's own risk.

8. Site Terms of Use Modifications

BRIM COLLECTION may revise these terms of use for its website at any time without notice. By using this website you are agreeing to be bound by the then-current version of these Terms and Conditions of Use.

9. Governing Law

Any claim relating to BRIM COLLECTION's website shall be governed by the laws of the State of Oklahoma without regard to its conflict of law provisions.

10. Messaging

We may send quote follow-ups, proof-approval requests, order and production updates, and occasional offers to existing customers or to people who have opted in to receive SMS notifications. These communications are sent via our website forms, our web chat, or in person.

You can cancel the SMS service at any time. Simply text "STOP" to the shortcode. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

If you experience issues with the messaging program, reply with the keyword HELP for more assistance.

Carriers are not liable for delayed or undelivered messages.

As always, message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.

12. Deposits and setup fees

A custom order is paid in two parts, and they are different kinds of money:

• Setup fees — design work, digitizing, and revisions past the first — pay for work we perform before anything is stitched or pressed. They are itemised on your quote and are never refundable once that work has been done.
• The deposit covers materials and the production slot for your order. It is due before production begins.

13. Cancellations and refunds

Your deposit is refundable up until you approve your proof and the order goes into production. Approving the proof is what starts production — once your order is on the machine it cannot be cancelled, and the deposit is no longer refundable. Setup fees are not refundable at any point after the work they pay for has been performed, whether or not the order goes ahead.

For party bookings: the booking deposit is fully refundable if you cancel seven or more days before the party. Inside seven days, the date can be moved once instead.

14. Proofs and production

Nothing goes into production until you have approved a proof. Approving a proof confirms the design, spelling, colours and placement — what we produce matches the proof you approved, and artwork placement may vary up to half an inch in any direction. The date your order will be ready is agreed per order when we quote it; if anything moves it, we tell you before it becomes your problem.

15. The store

Items sold through shop.brimcollection.com are made to order. Once production of a store order has started, the cancellation rule in section 13 applies to it in the same way. If something arrives wrong — a production error or a defect — contact us at hello@brimcollection.com and we will sort it out.
